A number of citizens who live at Simpson Lake Club have filed suit against the City of Brady in 198th District Court to stop development of the MUDualistic ATV Park adjacent to their homes.Their objections appear reasonable as outlined in the article entitled "City of Brady ATV Park Opposition - Three Reasons" published in November of last year.

 

These same citizens have repeatedly appeared before the City Council to ask for relief only to be answered with contempt, derision and harassment by the Mayor, Council Members, City Attorney and others. The local newspaper refused to publish their concerns while the project proceeded in a haphazard fashion without approved plans, permits, or developer financing.

 

As costs to the City of Brady escalated and the developer refused to honor the terms of the contract with the City, other citizens began to question the wisdom of the project even though their homes are not directly affected. Funneling city funds, equipment, labor and utilities to MUDualisitic, LLC, has already cost one City Department Manager his job. Hopefully, the District Court can get the attention of the City Manager, Mayor and City Council. Concerned citizens haven't been able to do that, even after many months of continuous, concentrated effort.

 

The Court Filing says in part:

This suit for declaratory and injunctive relief arises from the failure of the City of Brady, its elected officials, and its City Manager to adhere to state statutory requirements and its own charter and municipal code in connection with zoning for more than six hundred acres adjacent to Brady Lake and the residential area known as the Simpson Lake Club Subdivision. The City leased the disputed land to a private company -- MUDualistic, L.L.C. -- for operation of a private recreational facility for all-terrain vehicles. The use of the property under lease is inconsistent with zoning for the leased area. Also, the term of the lease for the property violates the City Charter of Brady.
